Adult Volunteer Liability Release and Confidentiality Form 

As a volunteer working with or representing Utah Foster Care, I understand that I may become aware of sensitive and confidential information regarding foster families, children, or other individuals involved with the foster care system, including but not limited to foster family addresses, identities of children in care, biological family information, and DCFS staff details. I agree to keep all such information strictly confidential and to refrain from discussing or disclosing it in any way outside of my authorized volunteer responsibilities.   

I acknowledge that this confidentiality extends to verbal and written information, as well as digital content like photos and videos, including release of information on social networking mediums and other public forums. I understand that failure to uphold this confidentiality could have a detrimental effect on the relationship with the child and/or family served and will subject the person(s) who made the unauthorized disclosure to appropriate discipline, including removal from future volunteer opportunities.  

Utah Foster Care has insurance coverage for all of our staff and volunteers. In addition, I hereby release and discharge Utah Foster Care, its employees, officers, directors, agents, volunteers, and affiliates from any claims, demands, or causes of action for personal injury or property damage arising from my child’s participation in Utah Foster Care events, except in cases of gross negligence or willful misconduct. 

I understand that volunteer activities involve certain risks, including but not limited to physical activities, potential injuries, unforeseen incidents, transportation, and exposure to sensitive situations related to foster care. I voluntarily agree to participate and assume all risks associated with volunteer activities. 

No Employee/Agent Relationship 

I understand and agree that participating in the Volunteer Program does not, nor should be construed to, create any type of employer/employee nor principal/agent relationship between Utah Foster Care and myself. 

Indemnification and Hold Harmless 

I also agree to INDEMNIFY and HOLD Utah Foster Care, its employees, officers, directors, officials, agents, volunteers, and affiliates HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorneys’ fees, brought by any third party as a result of my involvement in the Volunteer Program, and to reimburse them for such expenses incurred.  

Severability 

The undersigned further expressly agrees that the foregoing waiver of liability, assumption of risks and indemnity agreement is intended to be as broad and inclusive as permitted by the State of Utah and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. 

Acknowledgment and Understanding 

I have read this waiver of liability, assumption of risk, and indemnity agreement, and I understand its terms. I also understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily and intend my signature to be a complete and unconditional release of liability to the greatest extent allowed by law.

En consideración de que se me permita participar como voluntario en Utah Foster Care, yo, por mí mismo(a), mis herederos, representantes personales o cesionarios, por la presente libero, renuncio, eximo y me comprometo a no demandar a Utah Foster Care, sus empleados, funcionarios, oficiales y agentes, de toda responsabilidad por cualquier y toda reclamación, incluyendo la negligencia de Utah Foster Care, sus empleados, funcionarios, oficiales y agentes, que resulte en lesiones personales, accidentes o enfermedades (incluyendo discapacidad o muerte), así como daños o pérdidas a la propiedad, que puedan surgir directa o indirectamente de la participación en el Programa de Voluntariado. 

No existe relación laboral o de agencia 

Entiendo y acepto que participar en el Programa de Voluntariado no crea, ni debe interpretarse como que crea, ningún tipo de relación de empleador/empleado ni de principal/agente entre Utah Foster Care y yo. 

Indemnización y exoneración 

También acepto INDEMNIZAR y EXIMIR de responsabilidad a Utah Foster Care, sus empleados, funcionarios, oficiales y agentes de cualquier y toda reclamación, acción, demanda, procedimiento, costos, gastos, daños y responsabilidades, incluidos los honorarios de abogados, como resultado de mi participación en el Programa de Voluntariado, y reembolsarles dichos gastos incurridos. 

Divisibilidad 

El abajo firmante acepta expresamente que esta renuncia de responsabilidad, asunción de riesgos y acuerdo de indemnización está destinada a ser tan amplia e inclusiva como lo permita la ley del Estado de Utah, y que si alguna parte de este acuerdo se considera inválida, el resto continuará en pleno vigor y efecto legal.

He leído esta renuncia de responsabilidad, asunción de riesgos y acuerdo de indemnización, y entiendo sus términos. También entiendo que estoy renunciando a derechos, incluyendo mi derecho a presentar una demanda. Reconozco que firmo este acuerdo libre y voluntariamente, y que mi firma representa una liberación total e incondicional de responsabilidad en la mayor medida permitida por la ley. 

Minor Volunteer Confidentiality and Waiver Form

In consideration of my child being permitted to participate as a volunteer in Utah Foster Care programs, I, for myself, my heirs, personal representatives or assigns do hereby release, waive, discharge, and covenant not to sue Utah Foster Care, its employees, officers, directors, officials, agents, volunteers, and affiliates from liability from any and all claims, including the negligence of Utah Foster Care, its employees, officers, directors, officials, agents, volunteers, and affiliates, resulting in personal injury, accidents or illnesses (including disability or death) and property damage or loss, which might arise either directly or indirectly from participation in the Volunteer Program, except in cases of gross negligence or willful misconduct.

Confidentiality

My child may become aware of sensitive and confidential information regarding foster families, children, or other individuals involved with the foster care system. My child and I agree to keep all such information strictly confidential. I understand that failure to comply with confidentiality requirements may result in my child’s removal from volunteer opportunities.
